Watch Live: KSHSAA Board of Directors Discuss Reconsidering “No Spectators” During Winter Activities

Here is the agenda for Tuesday, December 8th via KSHSAA:

  1. Call to Order & Welcome – President
  2. Roll Call and Introduction of Members – Executive Director
  3. Waiver of 10-Day Written Meeting Notice
  4. Public Forum – (During the COVID-19 modified meeting format, public forum comments may be submitted by
    email only, by sending comments to Executive Director Bill Faflick at bfaflick@kshsaa.org, prior to 1:00 p.m.
    on Monday, December 7, 2020. Comments should be limited to items on the agenda. The subject line of the
    email when submitted should read “Board of Directors Public Forum Comments”. In order to be included in
    the public forum documentation for the Board of Directors, complete contact information (first/last name,
    street address, city/state/zip, daytime phone number, email) is necessary. Incomplete information will result in
    the comments not being included in the Board of Directors support material or the meeting minutes.
    Introduction, Discussion and Vote will be held simultaneously on the following action items:
    (Unless otherwise indicated, underlined portions are recommended changes in rules.)
  5. Pursuant to KSHSAA Handbook Bylaw VIII, Section 3:
    Sec. 3: In the case of an appeal from a decision of the Board of Directors, notification of such
    appeal shall be filed within thirty (30) days from the date of publication of such decision. The
    Appeal Board shall render a written recommendation not later than five (5) days after the close of
    the hearing, setting forth its findings of fact and recommendation as to the determination of the
    issues. The Appeal Board may recommend the decision of the Board of Directors be sustained or
    that such decision be reconsidered and revoked, modified or amended. The Appeal Board may
    recommend to the Board of Directors proposed amendments or modifications of such decision but
    the Board of Directors shall not be bound by the recommendations of the Appeal Board. The
    recommendations of the Appeal Board shall be submitted to the Board of Directors which shall,
    after considering the recommendations, make a final determination of the matter.
    As such, the following decisions from the November 24, 2020 meeting of the Board of Directors were
    appealed:
    For the period of December 1, 2020 through January 28, 2021, no spectators will be
    admitted/allowed for the KSHSAA sponsored interscholastic high school activities of basketball,
    bowling, scholars bowl, swimming & diving, and wrestling.
    and
    For the period of December 1, 2020 through January 28, 2021, no spectators will be
    admitted/allowed for the KSHSAA sponsored interscholastic middle school activities of basketball,
    bowling, scholars bowl, and wrestling.
    Accordingly, the KSHSAA Board of Directors is asked to receive and consider the following
    recommendation from the KSHSAA Appeal Board at their December 4, 2020 hearing:
    Because masks are already required for attendance at KSHSAA events, and because the science
    tells us that proper mask wearing and social-distancing effectively mitigate the risk of transmitting
    COVID-19, and because we believe that for several reasons, parents should attend their
    children’s activities, we propose the KSHSAA Board of Directors be reconvened for the purposes
    of reconsidering the decisions to prohibit spectators at high school and junior high/middle school
    events through January 28, 2021 with a recommendation to allow for attendance of one or two
    parents/guardians per athlete.
    Final determination on this matter will result from this meeting.
  6. Next Meeting — The next regularly scheduled meeting of the KSHSAA Board of Directors is scheduled
    Friday, April 30, 2021 at 4:00 p.m. to include hearings, discussion and final action.
